摘要：隨著社會經濟的快速發(fā)展，汽車已成為當今社會的主要道路運行工具，人們對汽車的需求增加導致二手汽車交易日趨活躍。而由于我國汽車市場受舊的政策和管理模式的影響，使汽車交易十分混亂，隨之訴諸法院的案件也不斷增多。如何處理此類案件，在法律界始終眾說紛紜。筆者結合自己承辦的案件，提出了在汽車交易中所存在的六個方面的法律問題，經逐一探討后，作出如下觀點：一、汽車買賣辦理過戶手續(xù)不是買賣合同生效的必備條件，不能因未辦理過戶手續(xù)就認定買賣合同無效；二、汽車買賣中物的占有與物權登記相沖突時，應根據(jù)登記所具有的物權公示效力及公信效力，保護善意第三人利益；三、汽車買賣未過戶的產權歸屬，應具體分析物權變動和債權平等性問題，存在于同一標的上的物權效力先于債權；四、關于承包經營中的汽車買賣關系，從訂立合同的目的、性質、內容和相關法律、法規(guī)的規(guī)定等方面分析，此類承包經營合同依法成立；五、汽車牌照是市場經濟的產物，具有價值，可以轉讓；六、對于認定未過戶的汽車交通事故賠償責任主體，不應依據(jù)車輛所有權的歸屬來確定，應確認運行支配和運行利益的歸屬者為賠償責任的主體。全文共約8000字。

AccordingtosomecasesthatIexperienced,therearelegalproblemsthatexistincarsdealing.Afterstudyingthemonebyone,Ipresentthefollowingopinions.

1.Transferringproceduresarenottheessentialconditionsofbecomingeffectiveofcontracts.Neverconsideritineffectivebecauseofnottransferring.

2.Incaseofconflictofwhoownsthingsandwhohastherighttoregisterincarsdealing,weshouldprotectthethirdperson’sinterestoutofgoodwill,accordingtoeffectiveproofs.

3.Abouttheownershipoftheuntransferredcars,weshouldpracticallyanalyzetheproblemsofthechangeofownershipandequalityofcreditors’rights,andtheeffectofownershipshouldbefavoredovercreditors’rightsifonthesameconditions.

2.Carlicensesaretheresultofdealingineconomylife,sotheycanbetransferred.

3.Onjudgementaboutwhoshouldbemainlyresponsibleforthecompensatingforthetrafficaccidentofcarsthatarenottransferred,weshouldn’tjudgebytheownershipofcarsbutweshouldjudgebywhocanbenefitfromthemanagementofthecars.
