摘要：循環經濟是21世紀經濟發展最先進的模式，它從根本上緩解和消除了環境與發展之間的矛盾，緩解人類社會的資源矛盾，實現經濟活動的生態化轉向。世界上先進國家早在上世紀就開始對循環經濟進行立法，并通過長期的實踐，制訂了一整套較為完善的循環經濟法律體系。我國與發達國家相比，循環經濟發展較為落后，目前還處在源頭防污的清潔生產階段，在法律體系上，只頒布施行了《清潔生產促進法》，而且該部法律條文內容較為原則，無實施細則。我國建筑業在循環經濟方向還處于從末端治理向源頭防治的過渡階段，我國建筑業的現狀按清潔生產的要求還存在較多不完善，對人類健康和環境污染的現象也尚未完全得到有效控制，故在我國建筑業大力促進清潔生產是十分緊迫且十分重要的。結合發達國家循環經濟的立法和模式的成功經驗，對我國建筑業促進清潔生產，發展循環經濟提出了制訂《建筑業清潔生產促進法》，制訂和調整建筑業有關規范和標準，根據清潔生產要求修改《建筑法》，制訂相關的規章制度等法律建議，使我國建筑業真正做到清潔生產，快速實現循環經濟。

Abstract:Circulationeconomyisthemostadvancedeconomicdevelopmentmodelinthe21#century.Italleviatesandeliminatesthecontradictoryrelationshipbetweenenvironmentanddevelopment,alleviatingthescarcenessofresourcesinhumansociety,andachievingecologicaltransitionofeconomicactivities.Developedcountriesbegantolegislateforcirculationeconomyfromlastcentury,andhaveestablishedaperfectlegalsystemforitthroughlong-paredwiththecirculationeconomyindevelopedcountries,thecurrentsituationinChinaislessadvanced,andisstillatthestageofcleanproduction,whichonlyfunctionsasinitialprevention.Fromtheperspectiveoflegalsystem,ChinesegovernmentjustenactedtheLawofAdvancingCleanProduction,whichonlycontainsprincipledarticlesinsteadofdetailedaccountsforexecution.Fromtheviewpointofcirculationeconomy,constructionindustryinChinahasnotsurpassedthelevel,onwhichthefinalregulationoradministrationistransitingtowardstheinitialprevention.InaccordancewiththeLaw,thecurrentsituationofconstructionindustryinChinahasnotfulfilledthelegalrequirementsfully,andthephenomenaofhumanhealthandenvironmentalpollutionhavenotbeenundercontrolcompletelyyet,biningthesuccessfulexperiencesoflegislationandmodelsofcirculationeconomyindevelopedcountriesandthecurrentsituationsinChina,thisresearchproposestoestablishtheLawofAdvancingCleanProductioninConstructionIndustry,tosetupandadjuststandardsinconstructionindustry,toamendtheLawofConstruction,andtoestablishrelevantregulationsandpolicies,inordertoachievecleanproductioninconstructionindustryandacceleratetherealizationofcirculationeconomyinChina.
